Plain-English Summary
DataPro360 is a monthly subscription at $69.95 per user. You get a 30-day free trial with no credit card required. There is no discounted launch rate and no grandfathered pricing — the price is the price, and if it ever changes you get at least 30 days’ notice. Your analysis data lives on your machine, not on our servers; optional cloud backup copies only what you choose. You can cancel at any time. You are the appraiser — DataPro360 is a tool, and every value opinion, adjustment decision, and report you produce is yours.
These Terms of Service (“Terms”) govern your access to and use of DataPro360, a subscription software platform provided by DataHub Solutions LLC (“DataHub Solutions,” “we,” “our,” or “us”). DataPro360 is accessed through your browser at app.datapro360.com and is marketed at datapro360.com.
By creating an account, starting a free trial, or otherwise using DataPro360, you agree to these Terms. If you do not agree, you may not use DataPro360. These Terms incorporate our Privacy Policy and our Refund Policy by reference.
1. Eligibility
DataPro360 is intended for professional use by adults aged 18 or older — real estate appraisers, assessors, and related professionals. By using DataPro360 you represent that you are at least 18 years old and have the legal authority to enter into these Terms on your own behalf or on behalf of the entity you represent.
2. Your Account and Seats
DataPro360 is licensed per user. Each person who uses DataPro360 must have their own seat under a subscription. You are responsible for everything that happens under your account, including activity by anyone you give access to. You agree to provide accurate registration information, keep your login credentials confidential, and notify us promptly at support@datapro360.com if you suspect unauthorized access. You may not share seat credentials between people; credential sharing is grounds for suspension.
Account authentication is handled by Clerk, our identity provider. You agree to Clerk’s terms when you create an account.
3. The Subscription
3.1 Free trial
Your subscription begins with a 30-day free trial. No credit card is required to start the trial. At the end of the trial, DataPro360 will prompt you to subscribe to continue. If you do not subscribe, your account is suspended; your local files are unaffected, and any cloud backup copies are retained for 30 days so you can subscribe and resume, after which they are permanently deleted.
3.2 Monthly billing
After the free trial, DataPro360 is billed monthly in advance at $69.95 per user per month to the payment method on file. Subscriptions renew automatically each month unless you cancel before the next billing date. Billing is processed by Stripe; we do not store your full payment card details. Organizations needing 50 or more seats should contact us for enterprise arrangements.
3.3 Pricing — no grandfathered rates
DataPro360 has one price for everyone: the then-current rate. We do not offer discounted launch pricing, and we do not grandfather earlier rates. If the subscription price changes, we will provide at least 30 days’ written notice before the change takes effect for existing subscribers. Your continued use after the change indicates your agreement to the new price; if you do not agree, you may cancel before it takes effect.
3.4 Cancellation
You may cancel at any time from Settings inside the app. Cancellation stops the next scheduled charge; you retain access through the end of the period you have already paid for. We do not prorate or refund partial months. See the Refund Policy for full details, including the seven-day refund window after your first charge.
3.5 Suspension for non-payment
If a payment fails, we will retry the charge and notify you by email. If the failure is not resolved within a reasonable period, your account may be suspended. Suspension never touches the files on your machine; cloud backup copies follow the 30-day retention described in Section 4.4.
4. Your Data
4.1 Local-first by design
DataPro360 is built local-first. Your analysis data — sales data you load, .dp360 assignment files, adjustments, comp grids, reports, and Narrative Briefs — lives on your machine. It is not uploaded to our servers in the ordinary course of using the software. Our cloud systems hold your account, billing, and subscription records, and the sync metadata needed to operate optional features you enable.
4.2 Optional cloud backup
If you enable cloud backup, copies of the files you choose are stored on Microsoft Azure infrastructure in the United States under a storage quota, so you can recover them or work across machines. Cloud backup only ever adds or releases copies — it never changes, moves, or deletes the files on your machine. You can disable it at any time.
4.3 Ownership and export
You own your data — every file, analysis, report, and Brief. We claim no ownership over it and no license to it beyond what is needed to operate features you use. Because your files live on your machine in open formats (including .dp360, Word, PDF, and markdown), there is nothing to export from us and nothing we could hold back if you cancel.
4.4 Cloud copies after your subscription ends
When your subscription ends — by cancellation, non-payment, or trial expiration — your cloud backup copies are retained for 30 days and then permanently deleted. Your local files are unaffected, forever. You may request earlier deletion of cloud copies by emailing support@datapro360.com.
4.5 Your MLS and data-source obligations
The sales data you load into DataPro360 comes from your own sources — your MLS, public records, and your files. You are responsible for complying with your MLS agreements and any other license terms governing that data. DataPro360 receives no MLS feed and grants you no data rights; it analyzes what you lawfully bring to it.
5. Professional Responsibility
DataPro360 is an analysis tool, not an appraiser and not an automated valuation model. It derives statistics, charts evidence, and assembles documents from the data and decisions you supply. Every value opinion, adjustment selection, reconciliation, and report produced with DataPro360 is yours, and you are solely responsible for its accuracy, for your compliance with USPAP and any other professional standards that apply to you, and for the decisions of any reviewer, client, or authority that relies on your work. DataHub Solutions does not provide appraisal, legal, tax, or professional advice.
The Narrative Brief feature prepares a briefing file you may choose to hand to an assistant or an AI service of your own. DataPro360 sends nothing to any AI service; if you share a Brief with a third-party service, that sharing is governed by that service’s terms, and the resulting narrative remains your professional responsibility.
6. The Software License
Subject to these Terms, DataHub Solutions grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use DataPro360 during your active subscription, for your own professional purposes. We and our licensors retain all rights in the software, including its design, statistical methods as implemented, documentation, and branding. Your data is yours; the software is ours.
7. Acceptable Use
Plain rules, folded here so there is no separate policy to hunt for. You agree not to:
- Share seats or credentials between people, or resell, sublicense, or provide DataPro360 to third parties as a service of your own.
- Copy, scrape, decompile, reverse engineer, or create derivative works of the software, or probe or disrupt its security or infrastructure.
- Use DataPro360 to violate your MLS agreements, data licenses, or any law, or to infringe anyone’s rights.
- Misrepresent DataPro360’s output — including presenting its statistics or drafts as an appraisal you did not perform or a conclusion you did not reach.
- Upload malicious code or use the service to harm others.
We may suspend or terminate accounts that violate these rules.
8. Availability and Changes to the Service
We work to keep DataPro360 available and improving, and we may add, change, or remove features over time. Because your files live on your machine, an outage of our systems does not take your work away, but features that depend on our infrastructure (sign-in, billing, cloud backup) may be temporarily unavailable. We do not guarantee uninterrupted service.
9. Disclaimers
DATAPRO360 IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAHUB SOLUTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT STATISTICAL OUTPUTS FIT ANY PARTICULAR ASSIGNMENT, OR THAT RESULTS WILL SATISFY ANY REVIEWER, CLIENT, OR REGULATOR.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAHUB SOLUTIONS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR PROFESSIONAL CLAIMS ARISING FROM WORK PRODUCT YOU PRODUCE, ARISING OUT OF OR RELATING TO DATAPRO360. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR DATAPRO360 IN THAT PERIOD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to defend and indemnify DataHub Solutions against claims arising from your data, your use of DataPro360 in violation of these Terms or of your MLS or data-license obligations, or the professional work product you produce.
12. Termination
You may stop using DataPro360 and cancel at any time. We may suspend or terminate your access for violation of these Terms, with notice where practicable. On termination, Sections 4 (as to retention), 5, 9, 10, 11, and 13 survive. Your local files are yours regardless.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Tehama County, California, and you consent to their jurisdiction. Before filing anything, contact us at support@datapro360.com — most issues resolve in one email.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to active subscribers by email and posted at datapro360.com/terms with a new effective date. Your continued use after the effective date constitutes acceptance.
